Article 1 – Definitions
For the purposes of these terms and conditions, the following definitions apply:

  • Consumer: the natural person who purchases products for personal use and not for resale or business purposes.
  • Day: calendar day.
  • Durable medium: any means that enables the consumer or entrepreneur to store information in a way that allows future reference and unaltered reproduction.
  • Entrepreneur: Guilly, the company offering products for sale through its online store.
  • Distance contract: a sales agreement entered into online between Guilly and the consumer.
  • General Terms and Conditions: the present General Terms and Conditions of Guilly.

Article 3 – Applicability
These general terms and conditions apply to all offers, orders, and agreements concluded between Guilly and the consumer via the Guilly online store.

By placing an order, the consumer agrees to these terms and conditions.


Article 4 – The Offer

  • All offers are non-binding and subject to availability.
  • Product descriptions and images are made with care. However, colors and details may vary depending on screen settings and manufacturing differences.
  • Pricing, availability, shipping costs, and return policies are clearly displayed at checkout.

Article 5 – The Agreement

  • An agreement is established when the consumer places an order through the Guilly website and receives an electronic confirmation.
  • Guilly reserves the right to refuse or cancel an order if payment authorization cannot be obtained, product availability is lacking, or fraud is suspected.
  • Upon delivery, Guilly will provide the consumer with order details and contact information for customer support.

Article 6 – Returns & Refunds

  • Guilly accepts returns within 14 days of delivery for eligible items.
  • For hygiene and safety reasons, underwear, swimwear, and other intimate apparel are non-returnable once opened or tried on.
  • To initiate a return, the consumer must contact Guilly at info@guillyunderwear.com within 14 days of delivery. Products must be returned unworn, unwashed, and in original packaging.
  • Refunds will be issued to the original payment method within 14 business days after returned items are received and inspected.
  • Return shipping costs are the responsibility of the consumer unless the item arrived defective or incorrect.

Article 7 – Pricing & Taxes

  • All prices are listed in U.S. dollars (USD).

  • Applicable state and local sales taxes will be added at checkout in accordance with U.S. law.

  • Consumers are responsible for any additional use tax obligations required by their state of residence.

  • Guilly reserves the right to adjust prices at any time.


Article 8 – Conformity & Warranty

  • Guilly guarantees that products comply with the descriptions provided on the website and are free from material defects at the time of delivery.
  • If a product arrives damaged or defective, the consumer must notify Guilly within 7 days of receipt.
  • Guilly may, at its discretion, replace the item, provide store credit, or issue a refund.
  • This warranty does not cover normal wear and tear, misuse, or improper care.

Article 9 – Delivery & Shipping

  • Orders will be processed and shipped within the timeframe stated on the product page or checkout.

  • Delivery times are estimates and may vary due to carrier delays or unforeseen circumstances.

  • Risk of loss or damage passes to the consumer once the order is delivered by the carrier to the provided shipping address.


Article 10 – Duration & Termination of Services

  • If Guilly offers subscription or recurring delivery services, the consumer may cancel at any time by providing written notice at least 7 days before the next billing cycle.
  • Guilly reserves the right to modify or terminate subscription services with reasonable notice.

Article 11 – Payment

  • Payment is due at the time of order through approved payment methods displayed at checkout.
  • The consumer agrees to provide accurate billing and shipping information.
  • In case of failed payments, Guilly may cancel the order or suspend further deliveries.

Article 12 – Complaints Procedure

  • Complaints must be submitted to Guilly within 7 days of receiving the product, with a clear description of the issue.
  • Guilly will respond to complaints within 14 days. If more time is required, the consumer will be informed of the expected resolution timeline.
  • Filing a complaint does not suspend the consumer’s payment obligations.

Article 13 – Disputes & Governing Law

  • These terms are governed by United States.
  • Any dispute arising from these terms or from purchases made with Guilly shall be subject to the exclusive jurisdiction of the courts located in United States of America
  • Guilly complies with the U.S. Federal Trade Commission (FTC) regulations on advertising, returns, and consumer protection.
